This Privacy Policy outlines our policies and practices regarding the collection, use, disclosure, and protection of your personal information when you interact with www.lovejoyrealestate.com, our mobile app, our text and email programs, and the related services we provide (collectively, the “Services”).
Acceptance of This Privacy Policy
By using the Services, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, you should not use the Services. We reserve the right to modify this Privacy Policy at any time by posting an updated version on our website and revising the “Last Updated” date above. Your continued use of the Services after a modification indicates your acceptance of the changes.
Location of Servers and Transfer of Information
Our website and the third-party services we use are hosted on servers located in the United States. If you are located outside the United States, your personal information will be transferred to, stored in, and processed in the United States. By submitting your personal information, you consent to its transfer to the United States and its storage, processing, and use in accordance with this Privacy Policy. United States data protection laws may differ from those in your country of residence.
Scope of This Privacy Policy
This Privacy Policy applies to your use of the Services. We do not own, operate, or control the websites or platforms of third parties — including individual real estate licensees, outside referral agents, lenders, title and escrow companies, home service providers, or social media platforms. Accordingly, this Privacy Policy does not apply to those parties’ websites, apps, or their respective collection, use, storage, and disclosure of your personal information. We encourage you to review the privacy policies of any third party before sharing information with them.

- Property search information: saved searches, saved favorites, search filters (price, neighborhood, beds/baths, features), and listing alerts when you use IDX/MLS search powered by our website or the Lovejoy app.
- Inquiry and lead information: when you request a home valuation, ask to be connected with a real estate broker, request a showing, ask a question, or otherwise contact us, we collect the information you provide and route it to the appropriate broker affiliated with Lovejoy Real Estate.
- Transaction information: if you become a client, we may collect information needed to facilitate a real estate transaction, including identification, financial pre-qualification information you choose to share, and information required by federal, state, and local law.
- Employment inquiries: if you apply for a position or express interest in joining the team, we collect the information you submit and route it to our hiring and operations team.
- Communications: emails, text messages, calls, voicemails, chat messages, and form submissions you send to us, including any attachments.
2. Information Collected Automatically
Even if you do not submit personal information, we and our service providers may collect information about how you use the Services (“Non-Personal Information”). This information generally cannot be used to identify you personally on its own and includes:
- Device and log data: IP address, browser type and version, operating system, referring/exit pages, pages visited, the order of those pages, time stamps, and time spent on each page.
- Cookies and similar technologies: small data files stored on your device that help us recognize you, remember your preferences, measure performance, and deliver relevant content and advertising. You can control cookies through your browser settings (see “Your Privacy Choices” below).
- Analytics and advertising tags: we use Google Analytics (GA4), the Meta Pixel, Google Ads conversion and remarketing tags, and similar technologies to understand how visitors use our Services, measure the performance of our marketing, and serve relevant ads on third-party platforms.
3. How We Use Information
We use the information we collect to:
- Provide the Services you request, including IDX/MLS property search, listing alerts, home valuations, and connections to a licensed broker;
- Respond to your inquiries and provide customer support;
- Send transactional communications about your account, saved searches, showings, transactions, and other Service-related matters;
- Send marketing communications about market updates, new listings, events, and other Lovejoy Real Estate content, where permitted by law and in accordance with your preferences;
- Improve, secure, and develop the Services;
- Measure and improve our marketing, including through analytics and advertising platforms;
- Comply with legal, regulatory, licensing, fair housing, recordkeeping, and tax requirements; and
- Detect, investigate, and prevent fraud, unauthorized activity, and abuse of the Services.
4. How We Share Information
We do not sell your personal information. We share personal information only as follows:
- Licensed brokers and our team: we share your information with the Lovejoy Real Estate brokers and staff who need it to respond to your inquiry, provide the Service you requested, or carry out a transaction.
- Service providers (data processors): we share information with vendors that perform services on our behalf, including HubSpot (CRM, email, marketing automation), Salesmessage (text messaging via HubSpot), the Lovejoy app provider (Homestack), our IDX/MLS data provider, RMLS and WVMLS (multiple listing services), our website hosting and security providers, Google (analytics and advertising), Meta (advertising), our e-signature and transaction-management providers, lenders and title/escrow companies you engage with, and other vendors that support our business. These vendors are contractually limited to using your information to provide services to us.
- With your direction or consent: when you ask us to share information with a lender, inspector, title/escrow provider, or other party.
- Legal and safety: to comply with applicable law, lawful process, or governmental request; to enforce our Terms of Use; to protect the rights, property, or safety of Lovejoy Real Estate, our clients, or others; or in connection with a corporate transaction such as a merger, acquisition, or sale of assets.
We do not sell or share mobile numbers, SMS consent, or message data with third parties or affiliates for their marketing or promotional purposes. Information sharing with subcontractors that support our text messaging program (such as our messaging platform and CRM) is permitted solely to operate the Service. All other sharing categories described above exclude text messaging originator opt-in data and consent; this information will not be sold or shared with any third parties.
5. Text Messaging (SMS) Program
Lovejoy Real Estate operates a text messaging program through HubSpot and our messaging provider, Salesmessage, registered under the carrier-required A2P 10DLC framework and operated in compliance with the Telephone Consumer Protection Act (TCPA) and applicable CTIA Messaging Principles and Best Practices.
- Consent. By providing your mobile number through a Lovejoy Real Estate form, the Lovejoy app, an agent, an event sign-in, or another disclosed channel, you give your express written consent to receive recurring automated and non-automated text messages from Lovejoy Real Estate at the number you provide. Consent is not a condition of any purchase or service.
- Message types. We send both transactional messages (such as appointment confirmations, listing alerts, showing requests, transaction status updates, and one-to-one agent communications) and marketing messages (such as market updates, new-listing notifications, open-house invitations, and occasional promotional content). Where required, we obtain separate consent for marketing messages.
- Frequency and cost. Message frequency varies based on your activity and preferences. Message and data rates may apply, based on your mobile plan.
- Opting out. You can opt out at any time by replying STOP, CANCEL, END, UNSUBSCRIBE, QUIT, or STOPALL to any message we send you. After you opt out, you will receive a single confirmation message and will not receive further marketing or automated text messages from that program. You may continue to communicate one-to-one with your broker by replying to that broker directly.
- Help. Reply HELP to any of our text messages for assistance, or contact us at the addresses below.
- Resubscribing. If you previously opted out and want to opt back in, reply START, YES, or UNSTOP, or sign up again through our website or app.
- Carriers. Supported carriers include (but are not limited to) AT&T, Verizon, T-Mobile, US Cellular, Sprint, Boost, MetroPCS, Cricket, and Google Fi. Carriers are not liable for delayed or undelivered messages.
- Mobile information sharing. As noted above, we do not sell or share mobile numbers, SMS consent, or message data with third parties or affiliates for their marketing or promotional purposes. We share this information only with the subcontractors needed to operate the messaging Service.
- Alternatives. Opting out of text messages does not opt you out of email, mail, or phone communications, and vice versa. You can update your preferences across channels by contacting us at the addresses below.
6. Cookies, Analytics, and Advertising
We and our service providers use cookies, pixels, tags, SDKs, and similar technologies to operate the Services, remember your preferences, measure performance, and deliver relevant marketing. This includes:
- Google Analytics (GA4): to understand site usage and improve the Services. You can opt out using the Google Analytics Opt-Out Browser Add-on.
- Google Ads & remarketing: to measure ad performance and show relevant ads on Google properties and partner sites. You can adjust ad settings at adssettings.google.com.
- Meta Pixel (Facebook/Instagram): to measure ad performance and show relevant ads on Meta properties. You can adjust ad preferences in your Facebook settings.
- HubSpot tracking: to identify your interactions with our emails (opens and link clicks) and pages so we can provide relevant follow-up.
Most browsers allow you to block or delete cookies through their settings. You can also use industry opt-out tools provided by the Digital Advertising Alliance and the Network Advertising Initiative. Blocking cookies may limit some features of the Services.

13. Oregon Residents (Oregon Consumer Privacy Act)
If you are an Oregon resident, the Oregon Consumer Privacy Act (OCPA) provides you with the rights described in Section 12, including the right to access, correct, delete, and obtain a portable copy of your personal data, and to opt out of certain “targeted advertising,” “sale” of personal data, and certain profiling. We do not sell personal data for monetary consideration. Residents of other U.S. states that grant comparable privacy rights may exercise those rights by contacting us at the addresses in Section 7. We will respond consistent with applicable law.
17. Do Not Track
Some browsers can be configured to send “Do Not Track” signals. There is no industry-standard response to these signals, and we do not currently respond to them. We do honor Global Privacy Control (GPC) signals where required by applicable state law as a request to opt out of “sale” or “sharing” of personal information.

Our Services may contain links to websites and online services operated by third parties — including MLS portals, social media, lenders, title and escrow companies, and home service providers.
