By accessing and using this Site, you accept, without limitation or qualification, these Terms of Use.
  2. Brokerage Licensing. Lovejoy Real Estate is a licensed real estate brokerage in the State of Oregon and the State of Washington. All real estate services described on this Site are provided through licensed real estate brokers affiliated with Lovejoy Real Estate. We are an Equal Housing Opportunity provider and comply with all applicable federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, marital status, source of income, or any other classification protected by law.
  3. Property Listings and IDX/MLS Data. Property listings, market data, and related information displayed on this Site are provided in part through the Regional Multiple Listing Service (RMLS) and the Willamette Valley Multiple Listing Service (WVMLS), and may be supplemented by third-party data providers. This data is provided for the personal, non-commercial use of consumers and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Information is deemed reliable but is not guaranteed. Listings are subject to change, prior sale, or withdrawal without notice. Square footage, lot size, school assignments, taxes, and HOA information should be independently verified.
  4. No Warranties; No Duty to Update.   7. System Outages, Slowdowns, and Capacity Limitations. Any computer system or other electronic device — yours, your internet service provider’s, or ours — can experience unanticipated outages, slowdowns, or capacity limitations.

You agree to indemnify, defend, and hold harmless Lovejoy Real Estate, its affiliates, and their respective officers, directors, employees, agents, suppliers, and third-party partners from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation by you of these Terms of Use or applicable law.
  10. Privacy. Lovejoy Real Estate respects the privacy of Site users. Please refer to our Privacy Policy, which explains users’ rights and responsibilities with respect to information disclosed through this Site, including our practices around HubSpot, the Lovejoy app, IDX/MLS search, cookies, analytics, and text messaging.
  11. Third-Party Links and Sites. This Site may contain links or references to websites maintained by third parties (including lenders, title and escrow providers, home service vendors, MLS portals, social media platforms, and others) over whom Lovejoy Real Estate has no control. Such links are provided merely as a convenience. Lovejoy Real Estate makes no representations as to the accuracy, currency, or completeness of any information on third-party sites and shall have no liability for any damages or injuries arising from such content. Inclusion of any third-party link does not imply endorsement or recommendation.
  12. Non-Confidential Information. Subject to any applicable terms and conditions set forth in our Privacy Policy, any communication or other material that you send to us through the internet or post on the Site by electronic mail or otherwise — including any questions, comments, suggestions, or the like — is and will be deemed non-confidential, and Lovejoy Real Estate shall have no obligation of any kind with respect to such information. Lovejoy Real Estate shall be free to use any ideas, concepts, know-how, or techniques contained in such communication for any lawful purpose. The use or misuse of these trademarks or any other materials on the Site, except as expressly permitted herein, is prohibited and may violate copyright law, trademark law, the law of slander and libel, the law of privacy and publicity, and applicable communications regulations.

These Terms of Use and your use of the Site shall be governed by the laws of the United States of America and the State of Oregon, without regard to its conflict of laws principles. Any legal action or proceeding related to this Site shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Multnomah County, Portland, Oregon, and you consent to the personal jurisdiction of those courts.
  18. Changes to These Terms. Lovejoy Real Estate reserves the right to alter, update, or delete materials from this Site and to modify these Terms of Use at any time at its sole discretion. Material changes will be reflected by updating the “Last Updated” date above. Your continued use of the Site after any such change constitutes your acceptance of the new Terms of Use.
